GENERAL TERMS

These Terms and Conditions of Use (hereinafter referred to as “Terms of Use”) govern your access to and use of the content, services, and platforms provided by Amplify Horizons Solutions Private Limited through www.astrobhagya.com (hereinafter referred to as “We,” “AstroBhagya,” “Us,” “Our,” “AstroBhagya Application,” or “Website”).

UPDATES AND MODIFICATIONS

AstroBhagya reserves the right to update, amend, or modify these Terms of Use at any time. Users are responsible for reviewing these Terms periodically to ensure continued compliance.

USER ACKNOWLEDGMENT AND CONSENT

By accessing or using the Website, you (“User,” “Member,” “You,” or “Your”) acknowledge that you have read, understood, and expressly agree to be bound by these Terms of Use. If you do not agree, refrain from clicking “I AGREE” and discontinue use immediately. Continued use of the Website constitutes acceptance of these Terms, including any future amendments.

SERVICE OVERVIEW

AstroBhagya is an online platform offering astrological content, reports, consultations (via telephone, video, or email), and related services (collectively “Content”). Services include both free and paid tiers (“Services”). Personalized services require registration as a Member. By registering, you agree to:

• Provide accurate, current, and complete information during registration.
• Promptly update your information to maintain its accuracy.

REGISTRATION AND ELIGIBILITY

Users must be at least 18 years old and legally capable of entering binding contracts under the Indian Contract Act, 1872. Registration requires valid contact details (e.g., phone number, email) or third-party credentials (e.g., Facebook, Google). Accounts are non-transferable. Users are solely responsible for maintaining account confidentiality and all activities under their account. Misrepresentation of information may result in account suspension or termination. You are, however, allowed to ask questions related to minors in your family as per the terms and conditions outlined herewith in this policy. 

SERVICE FEATURES

• Consultation with astrologers:
  Users may book instant or scheduled sessions based on astrologer availability. Consultation charges, duration, and availability are displayed on the astrologer's profile and may vary from time to time. AstroBhagya enables users to connect with verified astrologers through secure video consultations (and maybe call or audio).

• Communication Consent:
  Users expressly consent to receive calls/messages from verified astrologers registered with AstroBhagya or from Astrobhagya. Such communications may be initiated notwithstanding the user's registration on any National Do Not Call (DND) registry or similar telemarketing preference lists.

• First-Time User Offer:
  Eligible new users may receive a free or discounted introductory consultation, subject to promotional terms announced by AstroBhagya. Eligibility is determined based on factors such as mobile number, device identification, account history, and other verification mechanisms. AstroBhagya reserves the right to modify, withdraw, or deny the offer in cases of misuse or suspected fraud.

• Welcome Bonus & Wallet Credits:
  New users may receive welcome bonus credits, promotional wallet balance, cashback, or reward points upon registration or during promotional campaigns. Such credits are non-transferable, may have validity periods and usage restrictions, and cannot be exchanged for cash unless expressly stated by AstroBhagya.

• Wallet & Reward System:
  Users may add funds to their AstroBhagya wallet for seamless access to consultations and services. Promotional rewards, cashback, referral benefits, and bonus credits, where applicable, shall be governed by us.

• Promotional Offers:
  AstroBhagya may introduce special offers, discounts, referral rewards, cashback programs, or loyalty benefits from time to time. Eligibility and redemption of such offers shall be subject to the respective promotional terms.

USER OBLIGATIONS

• Post no unlawful, abusive, defamatory, or objectionable content.
• Refrain from unauthorized commercial use of services.
• Avoid IP infringement, privacy violations, or legal breaches.
• No fraudulent activities or multiple accounts creation.

PRIVACY AND DATA SECURITY

Your use of the Website is subject to AstroBhagya’s Privacy Policy, which outlines data handling practices. By using the Services, you consent to data collection, storage, and processing as described therein.

PAYMENT, REFUNDS, AND CANCELLATION

Payment Terms

All payments for consultations( and other services available on AstroBhagya) must be made through the payment methods provided on the Platform and will be available in the user's AstroBhagya wallet after successful processing. Users are responsible for ensuring sufficient funds and accurate payment information before initiating any transaction.

Taxes and GST

All fees displayed on the Platform are inclusive or exclusive of applicable Goods and Services Tax (GST) and other statutory taxes, as specified at the time of payment. Users agree to pay all applicable taxes, duties, levies, and government charges associated with their use of the Services.

Consultation Charges

Consultation fees are determined by individual astrologers and displayed on their respective profiles. AstroBhagya reserves the right to modify platform fees, convenience charges, promotional offers, and pricing structures at its sole discretion.

Cancellation Policy

Users may request cancellation of a booked consultation before the consultation has commenced, subject to the astrologer's availability and applicable cancellation rules. Once a consultation session has started, the booking shall be deemed utilized and shall not be eligible for cancellation.

Refund Policy

All payments made on AstroBhagya are intended for use on the Platform through the user's AstroBhagya Wallet. Payments are in advance and non-refundable (But in relevant cases shall be refunded to your AstroBhagya Wallet)

Except where required by applicable law, payments once successfully processed shall not be refunded to the original payment source, bank account, credit card, debit card, UPI account, or any other payment instrument used for the transaction

Refunds shall generally not be provided for:

• Completed consultations.

• Partially utilized consultation sessions.

• Services already delivered or rendered.

• User dissatisfaction arising from the nature, interpretation, or outcome of astrological guidance.

• Wallet credits, promotional credits, bonus amounts, cashback rewards, or referral benefits.

Approved refunds, if any, shall be processed to the user's AstroBhagya Wallet or original payment source, as determined by AstroBhagya, after deducting applicable payment gateway charges, taxes, or transaction fees where permitted by law.

Technical Disruptions

In the event a consultation cannot be completed due to verified technical issues attributable to the Platform, AstroBhagya may, at its sole discretion, provide a partial refund, wallet credit, or rescheduled consultation after reviewing the circumstances.

Promotional Credits and Wallet Balance

Any promotional credits, joining bonuses, cashback rewards, referral incentives, or complimentary wallet balances provided by AstroBhagya:

• Have no cash value.

• Are non-transferable and non-refundable.

• May be subject to expiry periods and usage restrictions.

• May be modified, suspended, or withdrawn at any time.

Future Products and Digital Offerings

AstroBhagya may, in the future, offer physical products, digital reports, courses, events, merchandise, or other services. Additional terms relating to such offerings, including delivery, returns, cancellations, and refunds, shall be governed by separate policies published on the Platform at the relevant time.

DISCLAIMERS AND LIMITATIONS

Services are for informational/entertainment purposes only. AstroBhagya does not guarantee accuracy, medical efficacy, or outcomes. Not a substitute for medical, legal, or emergency services.

TERMINATION

AstroBhagya may suspend or terminate accounts for violations of these Terms, fraudulent activity, or misuse.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by Indian law. Disputes shall be resolved through arbitration in Indore (MP) under the Arbitration and Conciliation Act, 1996. Courts in Indore retain jurisdiction for interim relief or IP issues.

PROHIBITED CONTENT

Strictly prohibited:

INTELLECTUAL PROPERTY

All content on the Website is protected. Unauthorized use is prohibited.

Terms & Conditions for Astrologers on AstroBhagya

These Terms and Conditions (“Terms”) constitute a legally binding agreement between AstroBhagya (Amplify Horizons Solutions Private Limited) and astrologers registering on the platform.

1. Eligibility & Registration

• Must be an Indian citizen, 18+, and eligible to provide astrology services.
• Valid ID, qualification (if any), and bank details are required.
• AstroBhagya may accept or reject registration at its sole discretion.

2. Nature of Engagement

Independent service provider relationship, not employer-employee. You're responsible for content and services provided.

3. Services on the Platform

• Offer astrology services like Vedic, tarot, numerology, etc.
• Professional and lawful conduct required.
• Poor ratings or misconduct may lead to suspension.

4. Commission & Payment Terms

• Astrologers receive earnings after deduction of platform commission and applicable statutory deductions.
• TDS on withdrawal amounts will be deducted in accordance with applicable Indian laws and regulations. The deducted amount may be claimed/adjusted while filing your Income Tax Return (ITR), subject to prevailing government rules. The TDS rate or related compliance requirements may be revised as mandated under applicable laws or regulatory guidelines.
• Any additional legal, regulatory, taxation, or compliance requirements, if applicable, shall be implemented as per prevailing laws and platform policies.
• Withdrawal requests can be initiated during the designated payout windows conducted twice every month. Approved payouts will be processed to your registered bank account within up to 72 hours after the respective withdrawal window closes. AstroBhagya reserves the right to further streamline, enhance, or modify the payout process in the future for improved convenience and faster settlements.
• Detailed payout structure, settlement timelines, and related operational policies will be shared upon successful registration and onboarding.

5. Pricing & Promotions

• You may suggest rates; final price decided by AstroBhagya.
• Promotions may apply; payouts on discounted rates.

6. Profile Usage & Platform Rights

• AstroBhagya may use your name, photo, ratings for promotions.
• No user contact outside the platform or cross-promotion allowed.

7. Conduct & Compliance

• No abusive, fraudulent, or unethical behavior.
• Breach may lead to suspension or delisting.
• Respect user data privacy.

8. Confidentiality & Data Protection

• Consultations are confidential.
• Follow India's data laws (DPDP Act, 2023).
• Breach may lead to termination/legal action.

9. Intellectual Property

Platform designs, content, and systems are proprietary to AstroBhagya.

10. Termination

Either party can terminate with 7 days’ notice. AstroBhagya may terminate immediately for serious violations.

11. Liability Limitation

AstroBhagya is not liable for disputes with users. You indemnify AstroBhagya for third-party claims.

12. Dispute Resolution

• Attempt amicable resolution first.
• Then arbitration under Arbitration and Conciliation Act, 1996.
• Jurisdiction: Indore, MP.

13. Amendments

Terms may change. Continued use means acceptance.
